Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a.At the worksite, on or about January 18, 2001, a rough terrain forklift (model no. 844c- 42; serial no. SEP96W16P22511) was used to support two employees working on a platform 25 feet in the air from grade. The platform extended three to four feet from both sides of the overall width of the truck. Among other methods, feasible and acceptable abatement methods to correct this hazard include, but are not limited to, the following; 1.Following the forklift manufacture's recommendation in their owner/operator manual for the rough terrain forklift (model no. 844C-42) which states if a personnel platform is to be used to lift employees, the platform is to meet ANSI B56.6 1992 (amended 1994), which states in paragraph 8.25 that the platform shall not "have a width greater than the overall width of the truck [measured across the load bearing tires plus 10 inches (250 mm) on either side]." 2. The original advice of the Lull manufacturer manual strongly recommended that the lift not be used to lift personnel.d
