Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard. In the maintenance department the DeMag electric overhead hoist, Model PLV 60, three ton capacity, was used to lift lowboy trailers and flat bed trailers weighing in excess of 9,000-14,000 lbs. Feasible and acceptable abatement methods to correct this hazard is to comply with the safe operating procedures recommended by ASME/ANSI B30.16-1.2.17 and the DeMag manual such as (but not limited to): Equip hoist with a scale to enable employees to determine the weight of the load. Ensure that loads heavier than the hoist capacity are not lifted.y

Feasible and acceptable abatement methods to correct the hazard is to comply with the safe operating procedures recommended by ASME/ANSI B30.16- 2.3.3 such as(but not limited to): Repair and/or replace the designated deficiencies found in the annual inspection before further use by employees.
