Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: An employee on the State Route 12 West Sanitary Sewer Extension and Pump Station Project was exposed to falls and crushing injuries while riding in the bucket of the power shovel. Among other methods, one feasible and acceptable abatement method to correct this hazard is to prohibit riding in the bucket of the power shovel and to provide safe access into the excavation. No additional abatement information is required for this item.
