Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: In that employees were exposed to the operation of forklifts without using the seat belts supplied by the manufacturer. ASME/ANSI B56.1-1993, "Safety Standard for Low Lift and High Lift Trucks", requires manufacturers to provide, and operators to wear seat belts (operator restraint systems): Workers throughout the facility operate forklifts (for example model #35SCTT-S, serial #H- 17644-3) without using the seat belts provided by the manufacturer.
