Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: An employee was observed performing survey duties in the roadway, and was not protected from live vehicular traffic through the application of advance warning signs to motorists. Among other methods, one feasible and acceptable abatement method would be to position appropriate advance warning signs as prescribed by ANSI D6.1 - 1971.
