Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall of 7'3" to the concrete pad below: The alleged violations below have been grouped because they involve similar or related hazards that may increase the potential for injury resulting from an accident. Outside, southeast corner of acid house - In order to gain access to the acid tank platform to check the valve on the tank, an employee were required to climb a ladder with rungs spaced in excess of 12" and side rails not extended 36" above the floor of the platform. Among other methods, one feasible and aceptable abatement method to correct this hazard is to construct a ladder meeting the requirements stipulated by ANSI A14.1-1975. Specific elements of the abatement shall be expected to include, but not necessarily limited to: (1) Construction of a ladder with a maximum rung spacing of twelve inches. (2) Installation of side rails/hand rails which extend thirty-six inches above the floor of the platform to assist an employee accesing the platform.
