Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed the hazard of being struck by a wall on or about July 11, 1994 during the erection process of the gable end wall and chimney chase constructed as one piece: Among other methods, one feasible and acceptable abatement method to correct this hazard would be to install this entire wall frame and chimney chase with the use of a crane or through the use of wall jacks. In addition, the single story wall by itself can be constructed and erected. Then, the gable end could be constructed and set by a crane when the trusses are installed.
