Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard(s) of falling, being crushed and electrical
shock:
The employer did not provide an American Society Of Mechanical Engineers
(ASME) code
elevator that met the minimum requirements of ASME A17.1-1993 Safety Code
for Elevators
and Escalators.
Feasible and acceptable abatement methods include but are not necessarily
limited to:
1.  Provide a hoistway free of any windows.
2. Provide floor (number) markings on all levels of the hoistway.
3.  Provide a permanent noncombustible stair to the machine (cable) room
with
handrails on
all open sides.
4.Provide a self closing and locking access door to the machine (cable)
room.  This door
must be provided with a spring-type lock arranged to permit the door to be
opened from
the inside.  This door shall be kept closed and locked to prevent
unauthorized access to
the room.
5.Provide guards or enclosure for live electrical contacts in the machine
(cable) room.
6. Provide guards of enclosures for all rotating shaft and other parts in
the machine (cable)
room.
7.Provide a permanent light fixture for illumination in the pit.  The
lighting shall provide
5 footcandels.  The light bulb(s) shall be externally guarded to prevent
contact and
accidental breakage.  The light switch shall be accessible from the pit
access
door.  A
duplex receptacle rated not less than 15 A, 120 V, shall be provided.
8. Install an emergency stop switch in the pit that is enclosed.  This
switch shall be so
located as to be accessible form the pit access door.
9.Provide vision panels in the horizontally swinging door (note: viewing
the location of the
elevator through the cracks or opening the door is not permitted).  The
area of the vision
panel shall be 24 square inches not to exceed 80 square inches.  The panel
opening shall
be glazed with wire glass not less than 1/4 inch thick.  The center of the
panel shall be
located not less than 54 inches nor more than 66 inches above the landing.
The vision
panel shall be protective grilles made of .0625 inch thick steel.  Grilles
shall be secured
by nonreversible screws or other tamper proof fasteners.  Grilles shall
contain openings
not larger than 3 inches in diameter.  Such openings shall be spaced at 1
inch center.
All edges shall be free of burrs and beveled.  Grilles shall be installed
on the hoistway
side of the door. 10.Provide a hoistway-door interlock to prevent the
operation of the driving machine by the
normal operating device, unless the hoistway-door is locked in the closed
position and
to prevent the opening of the hoistway-door from the landing side unless
the car is within
the landing zone.
11. Provide a metal landing sill that is substantially flush with the
floor surface of the
elevator landings and maintained to secure a foothold over the entire
width of the door
opening .
12.Provide proper markings which are permanently and securely mounted
consisting
of:
a.  Capacity Plates, which shall indicate the rated load of the elevator
in pounds.
Located in a conspicuous position in the car.
b.  Data Plates, which shall indicate the weight of the complete car
including
the
car safety and all auxiliary equipment attached to the car, the rated load
and
speed, the wire rope data and the manufacturer's name and year
manufactured.
Located on the car crosshead.
c.  Signs, which shall indicated the type of loading for which the
elevator is
designed and installed.  Located inside the car and in accordance with
section
207.5 of the 1993 ASME elevator code.
The material and markings of plates shall be done in accordance with
207.3c of the 1993
ASME elevator code.
13.Provide a marking plates on each spring buffer showing the load rating
and stroke.
14.Provide a hoistway access switch to allow the elevator car to be raised
above the landing
to permit access to the pit.
15.Provide the underside of wood platforms with sheet metal of at least
0.0164
inches in
thickness or painting with an approved fire-retardant paint having a flame
spread rating
of not over 50.
16.Provide a gate or door at the entrance of the car that complies with
section 204 of the
1993 ASME elevator code.
17.Light bulbs or tubes shall be externally guarded or coated to contain
the glass in case the
bulb or tube accidentally break.
18.Provide an operating device of the closed electrical type.  Rope
operating devices shall
not be used.
19.Provide an emergency stop switch located in or adjacent to the car
operating panel.
20.Provide an elevator layout drawing in accordance with section 214 of
the 1993 ASME
elevator code.
21.Have an acceptance inspection conducted by an inspector that meets the
qualification
requirements of ASME QEI-1.  The authorized inspector shall certify that
the tests have
been performed and provide a report of the tests.
22.Provide routine inspections of freight elevators at intervals not
longer than six months
in accordance with the 1993 ASME elevator code.
ABATEMENT:
STEP 1:A written plan of abatement shall be submitted to the Area Director
outlining the
administrative and work practice measures to control employees exposure to
the
hazards as referenced in this citation.
STEP 2:A written plan of abatement shall be submitted to the Area Director
outlining the a schedule for the implementation of engineering measures
to control employees exposure to the hazards referenced in this citation.
This
plan shall include, at a minimum, target dates for the following actions
which
must be consistent with the abatement dates required by this citation.
(1)  Evaluation of engineering control options;
(2)  Selection of optimum control methods and completion of design;
(3)  Procurement and operation of selected control measures;
All proposed control measures shall be approved for each particular use by
an
ASME QEI-1 qualified inspector.
STEP 3:Abatement shall have been completed by the implementation of
feasible
engineering controls and report of acceptance testing by a qualified
inspector.
