Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an LP-Gas explosion hazard: (a) Location: LP-Dispensing and Storage Area; On or about 10/3/95, the emergency shut-off lever on a 11,000 gallon combination LPgas service station/storage tank trailer, failed to shut off when a gas leak occurred after a hose connection broke away from the tank trailer. Among other methods, one feasible and acceptable abatement method is to ensure that every motor carrier is systematically inspected, repaired and maintained so that all parts and accessories are in a safe and proper operating condition at all times, as specified in 49 CFR, Part 396 of the Federal Motor Carrier Safety Regulations.
