Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Location: Bagging Area; The employer had not insured that the surge bin observation window would not be opened during operation of the bin. Opening of the observation window causes flames to be propelled through the window exposing employees working in the area to serious injuries. Feasible and acceptable abatement methods to correct this hazard include: 1. To bolt the observation window closed. 2. To instruct the employees not to open the observation window. 3. To consult with the manufacturers before altering the original design of the equipment.
