Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of falling 13 feet to the ground:
(a) Location - Jobsite, 116 Dartmouth Street:
On or about 10/12/96, an employee was working from a branch on a tree
wearing a
defective lanyard that was not removed from service when signs of wear and
damage was
found.  One employee was fatally injured.
Feasible and acceptable methods among others to correct this hazard is to:
a. Make sure all equipment including ropes and lines are inspected and
properly
maintained by each worker daily before use.
b. Make sure employees do not use any rope or line that is made unsafe by
damage or defect, or for any other reason.
