Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being struck:
(a) Location - Jobsite:
On July 7, 1997, an employee was exposed to the hazard of being struck
while working
in the close proximity of the backhoe while the machine was in operation.
Among other methods, one feasible and acceptable method to correct this
hazard is to
develop and implement a company policy which prohibits employees from
working in
the close proximity of heavy equipment where the arm or bucket can strike
or come in
contact with the employee while the machine is being operated.
