Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck: (a) Location - Jobsite, 33 Peter Street, Holliston, MA: On or about 9/23/97, an employee was exposed to the hazard of being struck while working in the close proximity of the excavator while the machine was in operation. Among other methods one feasible and acceptable method to correct this hazard is to develop and implement a company policy which prohibits employees from working in the close proximity of an excavator where the bucket could strike or come in contact with the employee while the machine is being operated.
