Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees was exposed to the hazard of being struck and crushed by a falling tree: (a) Location - Jobsite, 16 Stonewall Drive, Woburn, MA: On or about 11/17/97, an employee was fatally injured when a tree that was being felled struck him. Among other methods, feasible abatement methods are: 1. Sound an audible alarm prior to the felling of a tree and assure all employees are safety out of range when the tree falls. ANSI Z133.1-1979 Section 8.55. 2. Prior to felling, notch or back-cut any tree over 5 inches in diameter. ANSI Z133.1-1979 Section 8.5.4.n
