Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to crushing and amputation type injuries while operating
earthmoving and similiar
mechanical type vehicles that were not equipped with a servicable braking
system:
a) Gravel Storage Yard;  On 4-26-96 a Trojan Model 124 Front End Loader
was being operated
without a servicable braking system.  An individual was attempting to
chain the loader to an
inoperable dump truck to facilitate it's removal.  The individual received
a crushing type injury
when he was trapped and pinned between the loader bucket and the dump
truck.
Among other methods, feasible and acceptable methods to correct this
hazard are to:
1. Conduct daily operational/safety checks of all mechanical equipment.
2. Establish a preventative maintenance program to insure vehicle
discrepancies are identified
and corrected in a timely manner
3. Immediately remove from service any piece of equipment with
deficiencies that affect safe
operation.
