Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that safety
devices were missing from the automotive lift:
(a)  Shop, Forward Manufacturing, two post, asymetrical lift, Model DP07A,
serial number 119 EF 0249; the "slider" and other parts were missing from
the
"arm lock assembly" on the two arms used for lifting the vehicle on the
left side
of the automotive lift at the time of the accident, on or about October
20, 2003.
AMONG OTHER METHODS, ONE FEASIBLE AND USEFUL METHOD TO CORRECT
THIS HAZARD WOULD BE TO FOLLOW THE RECOMMENDATIONS MADE BY THE
ANSI/ALI b153.1-1990 FOR AUTOMOTIVE LIFTS - SAFETY REQUIREMENTS FOR THE
CONSTRUCTION, CARE, AND USE, SECTION 4.1.5, ARM RESTRAINTS:
Frame-engaging lifts not having a rigid superstructure, or portion
thereof, under the raised
vehicle shall be provided with swing-arm-pivot restraints capable of
resisting 150 pounds of
horizontal force at the end of the fully extended arm.

employees in that employees
were exposed to the possibility of the automotive lifts failing to perform
properly.  No periodic
inspection/maintenance procedure had been established for the automotive
lifts to determine
where lift failures could occur:
(a)  Shop, Foward Manufacturing, two post, asymetrical lift, Model DP07A,
serial number 119 EF 0249 and the other automotive lifts in the Shop; no
periodic
inspection/maintenace schedule set up for these lifts.
AMONG OTHER METHODS, ONE FEASIBLE AND USEFUL METHOD OF ABATEMENT
TO CORRECT THIS HAZARD WOULD BE TO FOLLOW THE RECOMMENDATIONS
MADE BY ANSI/ALI B153.1-1990 FOR AUTOMOTIVE LIFTS - SAFETY REQUIREMENTS
FOR THE CONSTRUCTION, CARE, AND USE, SECTION 7.3:
The owner or employer shall establish a periodic inspection procedure as
recommended by the manufacturer to ensure the safe operation of the lift.
Also included in the manufacturer's "Installation and Owners Manual", it
states:
MAINTENANCE, EVERY MONTH
1.  Lubricate the four inside corners of the legs with heavy duty bearing
grease.
2.  Check the hydraulic fluid level.  If necessary add oil
cross-referenced to Mobil DTE 24 or
Texaco HD 32.  These are petroleum based hydraulic oils, non-foaming,
non-detergent, and ISO
32.  Fill to screw near top of tank.  Do not overfill.
3.  Check carriage latch synching:  Latches should click at the same time.
Adjust cables if
required.  Instructions are in the "Installation Text".
4.  Check anchor bolt tightness.  If the anchor bolts are excessively
loose, check more often.
5.  The troubleshooting and maintenance procedures described in this
manual can be done by
the lift's owner/employer.  Any other procedure should only be done by
trained lift service
personnel.
6.  Replace worn or broken parts only with genuine Forward Manufacturing
Company parts or
their equivalent.

of the automotive lifts were inadequately trained in the safe use and
operation of the lifts:
(a)  Shop; Forward Manufacturing, two-post, asymetrical lift, Model DP07A,
Serial Number 119 EF 0249; employees were not trained using the
manufacturer's literature nor the ALI publications.
AMONG OTHER METHODS, ONE FEASIBLE AND USEFUL METHOD OF ABATEMENT
WOULD BE TO FOLLOW THE RECOMMENDATIONS MADE BY ANSI/ALI B153.1-1990
FOR AUTOMOTIVE LIFTS, - SAFETY REQUIREMENTS FOR THE CONSTRUCTION,
CARE AND USE, SECTION 7.2.2 - INSTRUCTIONS TO THE OPERATOR:
The owner or employer shall ensure that operators of automotive lifts are
instructed in the safe use and operation of the lift using the
manufacturer-provided
instructions and the Automotive Lift Institute publications, "Lifting It
Right",
SM89-1 and "Safety Tips", ST90.
