Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer and the
building owner did not furnish employmnent and a place of employment which
were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to:
On or about May 24, 2001, employees who worked inside the general
merchandise store were
exposed to the hazards associated with failing structural members and
possible building collapse.
a. The concrete floor had several large cracks and breaks that compromised
the integrity of the
structure.
b. The panel board was exposed to water due to a leaking roof creating the
hazard of
electrocution.
c. The concrete block exterior wall had several severe cracks and breaks
that compromised the
integrity of the structure.  The concrete blocks in the wall near the
storage area on the back wall
of the store had separated as much as approximately 2 inches.
Methods of correction for each hazard include the following:
a) Repair the concrete foundation such that it is sound and capable of
supporting the intended
load.
b) Repair the damaged portions of the roof and flooring so that they are
sound, tight, and have
no defects that admit water.
c) Replace broken concrete blocks and apply caulking in the concrete block
mortar.
