Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to recognized hazards of fire and explosion: a) On or about May 5, 2000 the employer did not provide appropriate safety precautions to prevent a fire and explosion during the manufacturing process of Bromette 385. Among other methods, one feasible and acceptable means to correct the hazardous condition may include: Use of appropriate non heat source equipment with no agitation / gentle tumble blending and an extinguishing system to detect any sparks that may occur during the manufacturing process.
