Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from elevations: On or about Friday, June 30, 2000, Mount Enterprise, Texas; employees working on the construction of a cooling tower at the Tenaska Gateway Generating Station were permitted to enter and exit a man-basket work platform, mounted on the forks of a Lull, 6K-37, rough terrain fork lift, while the basket was elevated approximately 30-feet above the ground. Among other methods, recognized means of abatement include, but are not limited to: Lowering the platform to floor (ground) level for personnel to enter and exit, as required by the American Society of Mechanical Engineers (ASME) standard B56.6 - 1992 ( Safety Standard for Rough Terrain Forklift Trucks), Part III, chapter 5 (General Safety Practices), section 5.15.1 (Elevating Personnel), paragraph (w).graph
