Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
Employees working at the intersection of Horizon Rd. and Tubbs Rd.,
Rockwall, Texas,
were exposed to the recognized hazard of a hazardous atmosphere while
performing an
entry into a confined space.  The employer did not ensure that the proper
equipment and
procedures were used and followed, in that:
The employer's own written program, documented and generally communicated,
concerning confined space entry was not followed. Entry(ies) made to the
waste
water manhole on or about August 22, 2000 were not authorized by the
consultation, use or completion of an entry permit; pre-entry and
continuous
monitoring of the atmosphere inside the manhole was not conducted; suitable
respiratory protective equipment was not available and used; and non-entry
retrieval equipment was not available and used.
Among other methods, recognized and feasible means of abatement to correct
this hazard
include, but are not limited to :
a)  Full implementation of the applicable elements outlined in the
employer's own
written program.
b)  Full implementation of the applicable elements required by the American
National Standards Institute (ANSI) standard Z117.1 (Safety Requirements
for
Confined Spaces), section 5 Permit Required Confined Spaces, section 6
Atmospheric Testing, section 11 Personal Protective Equipment, and section
12
Safeguards.
