Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) In the metal storage area, employees were exposed to the hazard of impalement from the metal bars used to keep the metal in rows. The half-inch diameter metal bars protruded vertically from the floor approximately 18 inches and were not guarded or covered to prevent impalement or related hazard if an employee fell in the area.
