General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about 9-10-95, the employer had not ensured that employees wore their fall protection in bin #19 working off a circular 22 foot diameter wooden scaffold deck, approximately 103 feet in the air, thus exposing them to a fall hazard. Batterton Waterproofing, Inc. was previously cited for a violation of this Occupational Safety and Health Standard or it's equivalent standard CFR 1926.28(a), which was contained in OSHA inspection number 115070146, citation number 1, item number 1, issued on 05-03-95. Among other methods, one feasible and acceptable abatement method to correct this hazard, would be to enforce the use of fall protection that was available .
