Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of being caught between the elevator floor and the bottom of the elevator pit or falling into the elevator pit due to the employer not providing complete operational door or gates with interlocking devices on the west personnel/freight elevator. Among other methods of abatement, one feasible and acceptable method to correct this condition is: repair the interlocks for the west elevator so that gate guards must be in the closed position for the elevator to operate.
