Section 5(a)(1) The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing, or were likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling approximately 30 feet to the ground below: On Phase I of the warehouse, employees erecting the structural steel building from a platform lifted by a Gehl rough terrain forklift, Model #883, were unprotected from falls. The platform was not guarded with a standard guardrail on all open sides and an employee climbed over the existing guardrail onto the forklift boom to achieve additional reach. Additionally, the platform was not secured to the forks of the lift. Among other methods, one feasible and acceptable abatement to correct this hazard is to utilize a personnel platform in conformance with the following sections of ASME B56.5-1992, American National Standard for Rough Terrain Forklift Trucks: PART IIFor the User 5.15.1If a rough terrain forklift truck must be used to lift people, the following precautions for the protection of personnel shall be taken: (a) Provide a personnel platform which complies with design requirements listed in Part III of this Standard. (b) Be certain that the platform is securely attached to the lifting carriage or forks. (k) Be certain that required restraining means such as railings, chains, cable, body belts and lanyards, etc., are in place and properly used. (u) Personnel are to maintain firm footing on platform floor unless secured by body belt and lanyard. Use of railings, planks, ladders, etc., on the platform for the purpose of achieving additional reach is prohibited.
