Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fall hazards:
On the north side of the church, an employee riding on a platform which
was being lifted on the
forks of a Caterpillar rough terrain fork lift was unprotected from the
hazard of falling 16.8 feet
to the ground below, due to the fact that the personnel platform was not
securely attached to the
lifting carriage and forks of the lift.
Among other methods, one feasible and acceptable method of abatement
includes, but is not
limited to operating the rough terrain forklift in accordance with
ANSI/ASME B56.6 - 2002,
American National Standard, Safety Standard for Rough Terrain Forklift
Trucks which states
the following in Part II - For The User:
5.15  Elevating Personnel
5.15.1  A rough terrain forklift shall not be used to lift people unless
there is no other
practical option.  If a rough terrain forklift must be used to lift
people, the following
precautions for the protection of personnel shall be taken:
(b) be certain the platform is securely attached to the lifting carriage
and forks;
