Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fall hazards:
On the north side of the Microtel Hotel, an employee riding on a pallet of
shingles which was
being lifted on the forks of an Ingersoll Rand, model number VR-70B, rough
terrain fork lift
was unprotected from the hazard of falling 28.5 feet to the ground below,
due to that fact that
a personnel platform equipped with a means of restrain was not utilized.
Among other methods, one feasible and acceptable method of abatement
includes, but is not
limited to operating the rough terrain forklift in accordance with
ANSI/ASME B56.6 - 2002,
American National Standard, Safety Standard for Rough Terrain Forklift
Trucks which states
the following in Part II - For The User:
5.15  Elevating Personnel
5.15.1  A rough terrain forklift shall not be used to lift people unless
there is no other
practical option.  If a rough terrain forklift must be used to lift
people, the following
precautions for the protection of personnel shall be taken:
(a) provide a personnel platform which complies with the design
requirements listed in
Part III of this Standard;
(b) be certain the platform is securely attached to the lifting carriage
and forks;
(c) be certain that the lifting carriage and forks are secured to prevent
them from pivoting
upward;
(k) be certain that the required restraining means such as railings,
chains, cable, body
belt(s) with lanyard(s), etc., are in place and properly used;
(u) personnel are to maintain firm footing on platform floor unless
secured by body belt
and lanyard.  Use of railings, planks, ladders, etc., on the platform for
the purpose of
achieving additional reach or height is prohibited.
