Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that:
(a)On December 29, 1997, at 2140 South Calhoun Road, New Berlin, WI. 53151,
an  employee was performing a repair function on an Allis Chalmers
Industrial
Tow Tractor, Serial #39233, Model #479601, without the drive wheels being
raised off of the floor.  Ensuing drive train reaction caused tow tractor
to bump
into and dislodge an adjacent GMC Truck Van Wisconsin Plate #3704 which was
blocked up with the four wheels having been removed.  The Van subsequently
fell on an employee working underneath sustaining fatal injuries.  The
ASME/ANSI B56.9-1987 "Safety Standard For Operator Controlled Industrial
Tow Tractors", Section 6.2.1(a) specifies the raising of the drive wheels
free of
the floor before repairs are undertaken.
(b)Authorized personnel assigned to repair Industrial Tow Tractors did not
demonstrate a trained response as required in Section 6.2(b), in that,
compliance
with the specified measures addressed in ASME/ANSI B56.9-1987 Section
6.2.1.(a) were not met to prevent drive train reaction of the Industrial
Tow tractor
described in paragraph (a) as it was undergoing governor adjustment with a
high
throttle condition.
Among feasible abatement procedures alluded to in the ASME/ANSI B56.9-1987
"Safety
Standard" are to raise the drive wheels off of the floor to control
potential inadvertent drive train
reaction.
