Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by flying debris in the event of a ruptured compressed air line: At this location in the machine shop, the compressed air system (operating at 90 p.s.i.g.) provided for employee use was hazardous in that the piping of the system consisted of schedule 40 PVC. PVC pipe is subject to failure and or shattering when exposed to the pressures of compressed gasses. A means of abatement would be to replace the existing PVC piping with a type suitable for the transmission of compressed gasses.
