Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of getting thrown out of the operator's seat and being crushed by industrial lift truck: a)Throughout TRF area - Employees operating HYSTER and other types of lift trucks were not using the seat belt(s), on or about 9/12/96. Among other methods, one feasible and acceptable abatement method to correct this hazard is to enforce the use of seat belts on all equipment having seat belts installed in order to comply with a particular standard: 1. Ensure that employees utilize seat belts while operating industrial trucks.
