Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of falling into an open elevator shaft when
doors are accidentally
opened due to the lack of properly operating door interlocks:
(a)At F.T.G. Mfg., Broad Street, second and third floor, the elevator
interlock for
the door was not working properly at either floor allowing the door to be
potentially
opened when the elevator is not present.  On the second floor, a bolt that
was part of the
interlock was loose and on the third floor, a bolt that was part of the
interlock was
missing, on or about 3/3/95.
Among other methods feasible methods to eliminate this hazard is to insure
that elevators
are in safe operating condition by utilizing the New York State Department
of Labor Industrial
Code Rule 8.  Elements include, but are not limited to:
All manually operated hoistway doors or gates shall be provided with an
interlock or
electric contact as specified in section 8-1.55(b) of the code which
states any force or forces used
to perform any interlocking function shall be so arranged that their
failure to cause the
interlocking action will prevent the movement of the car.
Additionally, in accordance with section 8-1.7(a) and (b):  All parts of
the elevator
machinery, the hoistway gates and doors and car safeties, shall be
maintained in a safe condition
and freight elevators shall be inspected in time intervals to conform with
current New York State
code.  Inspection reports showing date of inspection and condition of the
elevator and hoistway
shall be prepared and signed by the person making such inspection; the
reports shall be made
on a form provided by and with such information as required by the
Industrial Commissioner
and shall be kept on file for examination.  A report by a recognized
casualty company will be
acceptable in lieu of the above if it contains the required information.
Additionally, in accordance with section 8-1.8(a) and (b)  All elevator
cars shall have a
sign posted conspicuously, which shall show the maximum rated load that
can be carried on
the elevator and all freight elevator cars shall have a sign posted
conspicuously, reading as
follows:  "PASSENGERS NOT PERMITTED".
