Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Industrial trucks in use did not meet the applicable requirements of design, testing, construction, stability, inspection, testing, maintenance, and operation as defined in American National Standards Institute B56.6-1992, Safety Standard for Rough Terrain Forklift Trucks: a.Dome #1 and Dome #2, Gradall Multi-Purpose Material Handler, Model 544, Rough Terrain Forklift, Serial Number 0155 263A, with a forty foot long material/man basket attached to the forks, used to hoist steel rebar rods and personnel to heights exceeding 30 feet. "AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS:" A.To discontinue the use of the forty foot long basket to hoist personnel. B.Follow the requirements for design and use of personnel baskets listed in Sections 5.15 and 8.25 of American National Standards Institute B56.6-1992, Safety Standard for Rough Terrain Forklift Trucks.t
