SECTION 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause serious physical harm to employees in that employees were exposed to: a)Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to the hazard of being infected with Mycobacterium tuberculosis through unprotected contact with jail inmates, nursing home patients and the general public who were infectious or suspected to be infectious with tuberculosis in that a Tuberculosis infection control program, which includes the use of the proper respiratory protective devices, was not developed nor implemented at the worksite. Feasible and useful abatement methods for reducing this hazard, as recommended by the Centers For Disease Control, include, but are not limited to: 1.Implementation of a protocol for the early identification of individuals with active Tuberculosis. 2.Instigating a medical surveillance program which ensures that current employees be tested initially and periodically for Tuberculosis infection. 3.Provide employees information on the signs and symptoms of TB, mode of transmission, and site specific protocols used to ensure worker safety and health. 4.Obtain and require employees to use proper respiratory protective devices, which dictates the development of a respiratory protective program. 5.Institution of post exposure evaluation procedures to be followed in the event of an exposure incident.
