Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from aerial lifts: Lowes construction site, As controlling employer, did not ensure that aerial lifts used on the site were used in accordance with ANSI A92.6 and ANSI A92.5. a)Employees climbed on midrails to gain additional height on aerial lifts used by Lenz Decorating. b)Aerial lift used by Lenz Decorating did not have safety instructions from the rental company or aerial lift manufacturer. Feasible and acceptable abatement methods include but are not necessary limited to: 1.Provide directional controls that are clearly marked to the function and of the type that return to the off or neutral position. 2.Provide each platform with an appropriate operating/maintenance manual. 3.Provide daily inspection on the aerial lift for cracked welds, hydraulic leaks, damaged control cable, loose wire connection, and tire damage. Inspect control daily for proper operation. 4.All modifications and alterations to work platforms shall be certified in writing by the manufacturer or by equivalent entity. 5.Provide fall arrest when employee must gain additional height on aerial lifts. 6.Provide operator training in the manufacturer's instruction and safety rules.
