Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed between the lift and the floor due to the failure of the hydraulic system: Employees work under the automotive lifts without engaging the locking mechanism on lifts that can be locked in any position. Employees working under lifts that can only be locked in the fully raised position are not provided supports to prevent the lifts from falling in the event of a failure when working under the lift when it is only partially raised.
