Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to death from falling while using an aerial lift that had cracks and holes in the fiberglass bucket: St. Mary's Church. National aerial lift had cracks and holes in the bottom of the bucket. Among feasible abatement methods is to replace the bucket and inspect the lifts in accordance with American National Standards Institute Guideline for Vehicle Mounted Aerial Lifts, Standard A92.9-1990.
