Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: Employees were exposed to the hazard of being struck by or caught in malfunctioning machinery and equipment due to damage not noted as there was no adequate program of periodic inspections nor an adequate maintenance program established for the hydraulic power presses and die cast equipment as evidenced by missing disconnects, hydraulic fluid leaking onto floor at machinery, unlabelled controls, exposed wiring, palm buttons not recessed, hydraulics not working on die cast equipment doors and two hand controls improperly adjusted on a hydraulic press. Among other methods, one feasible and acceptable abatement method to correct this hazard is to comply with A.N.S.I. B11.2-1982, Standard for Machine Tools - Hydraulic Presses - Safety Requirements for Construction, Care and Use and A.N.S.I. B152.1- 1973, Standard Safety Requirements for the Construction, Care and Use of Die Casting Machines by establishing and following a program of periodic inspections and maintenance for machinery and equipment including but not limited to hydraulic power presses and die cast equipment to ensure that all parts, auxiliary equipment and safeguards are in safe operating condition and adjustment.
