Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were routinely exposed to the hazards of fire and
explosion during the course of their employment; the following
condition contributed to the existence of this hazard:
Boat Shop - Where employees were responsible for working with
methyl ethyl ketone peroxide (MEKP) as well as flammable materials
such as polyvinyl alcohol, the employer did not provide a separate
storage facility for MEKP away from easily oxidizable, organic, or
other easily combustible materials which may have resulted in
ignition, violent combustion or explosion.
Abatement Note: One feasible means of abatement, among others,
would be to store the MEKP in either an outside storage facility or
one which would be away from other oxidizers as well as organic
and/or combustible materials which, in the event of a fire, could
not become involved in the incident.
