Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to fall hazards:
(a)Employee, standing in the bucket of the John Deere model 325 skid steer
while
cutting twine off of a tree, was exposed to falling 6 feet, 11 inches to
the concrete
sidewalk.
Among other methods, feasible and acceptable abatement methods could
include,
but are not limited to, following the instructions provided by the
Association of
Equipment Manufacturers Safety Manual for Skid Steer Loaders and never use
the bucket for a work platform or personnel carrier; and use a ladder to
access
the twine or cut the twine off of the tree before it is installed.
Certification, and documentation/evidence of abatement is required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten (10)
calendar days after the abatement date.ment
