Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a)On or about March 28, 2001, at a worksite located at 9083 Kensington Way, Franklin, WI, an employee working on a platform attached to a JCB rough terrain forklift truck with an extensible boom installing windows and trim, was not wearing a personal fall arrest system. Feasible abatement would be to obtain approval from the lift truck manufacturer before lifting personnel and comply with the American National Standards Institute (ANSI) B56.6 1992 Safety Standard for Rough Terrain Forklift Trucks which specifies the design, manufacture and use of all attachments for Rough Terrain Forklift Trucks. Certification, with date and method of abatement required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
