Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a)At the worksite at the Allright Parking structure at 601 West Wells, Milwaukee, WI 53203, the worker was chiseling concrete from the ceiling of the level above from a Terex extensible boom platform (self-propelled) and had no personal fall arrest system. Among feasible abatement would be to comply with the American National Standards Institute (ANSI) A92.5 - 1992 Standard for Boom-Supported Elevating Platforms and have employees wear fall arrest equipment whenever they are in an aerial lift. Without such protective equipment the worker was exposed to the hazard of falling to the concrete about 20 feet below. No certification required. Violation Abated.on
