Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees
performing order picking operations were exposed to fall hazards:
(a)On and before October 25, 2005, employees of The Boelter Company, Inc.,
performed work from order pickers without rails in place, or wearing a
harness
attached to a lanyard. The employer did not enforce the use of rails and a
harness
with a lanyard to be used while conducting order picking operations.
Among other methods, a feasible and acceptable method to correct this
hazard is
to follow the American Society of Mechanical Engineers (ASME), B56.1-2004;
Safety Standard for Low Lift and High Lift Trucks, Part II, Section 4.17.2
(Elevating Personnel) Sub (c).
Certification, and documentation/evidence of abatement is required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten (10)
calendar days after the abatement date.ment
