Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a) On or about April 26, 1995, pallet on lift truck forks used as a
scaffold exposed
painting employee(s) to a fall.
Among other methods, one feasible and acceptable abatement method to
correct these hazards
is to establish and enforce the use of the following precautions when
elevating personnel such
as that stipulated by ANSI B56.6 1978.  American National Standard, Rough
Terrain fork lift
trucks.  Essential elements of these precautions would include;
Whenever a truck is used to elevate personnel, the following precautions
shall be taken
for the protection of the personnel being elevated:
1. Use a work platform secured to the lifting carriage and/or forks.
2. Provide such overhead protection from falling objects as indicated
necessary by the
operating conditions.
3. Provide a slip resistant floor, toe boards and either standard
guardrails in conformance
with local requirements or a safety belt and lanyard.
4. Have an operator in the control station on the truck or in the
immediate area or
provide truck controls, including power-shut off, on the elevatable
platform.  Provide
means to render inoperative all operating controls other than those on the
elevatable
platform when the controls on the elevatable platform have been selected
for use.  Only
one location of controls shall be capable of being operated at one time.
5. Make sure the lifting mechanism is operating smoothly.
6. Place mast vertical and never tilt platform forward or rearward when
elevated.
7. Place truck in neutral and set parking brake.
8. Lift and lower smoothly and with caution.
9. Watch for overhead obstructions.
10. Keep hands and feet clear of controls other than those in use.
11. Never transport personnel on the work platform from one location to
another.
12. Provide protection for personnel in their working position from moving
parts of the
truck that represent a hazard.nt
