Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At building #324, the employee installing pipes to hold the plastic sheeting around the scaffold was exposed to fall hazards when working from the work platform elevated by a construction industrial truck. Among other methods, one feasible and acceptable method to correct this hazard would be to follow paragraph 513 of ANSI B56.1-1975, American National Standard for low and high lift trucks. 1. Use a guarded safety platform secured to the lifting carriage and/or forks, 2. Ensure an operator is in the control position of the truck.
