Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of inadvertent admixture of the spent acid and cyanide waste and the adjacent storage hydrogen peroxide. (a) Plating Area: Hydrogen peroxide was stored adjacent to the acid and cyanide waste, which could result in inadvertent intermixture. A mixture of these chemicals could result in employees being exposed to a build-up of hydrogen cyanide gas. Among other methods, one feasible and acceptable abatement method to correct this hazard is to physically separate the hydrogen peroxide to an area away from the waste tanks.
