Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that the employer
did not have an effective protective maintenance program which included a
safety
check
procedure by a qualified mechanic to detect potential mechanical failures
that would not be
visible to an untrained person.
Worksite: An employee fell 26 feet from a boom ladder after the pin which
acts as a pivot point
sheered and the ladder collapsed.
Among other methods, one feasible and acceptable method of abatement to
prevent similar
accident is to implement a maintenance program where a qualified mechanic
would inspect and
maintain the equipments and implement a daily check up procedure to
document the condition
of the equipment after and before every use.
