Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that an employee
was exposed to the hazard of a fall:
Worksite- An employee was observed cleaning and/or loosening up the chute
of the topsoil
screener with a sledge hammer from the bucket of the Cat excavator. The
bucket was raised to
approximately 11 feet from the ground, and the employee was not protected
from the hazard of
fall.
Among other methods, one feasible and acceptable abatement method to
correct the hazard is
to:
1. Utilize properly and safely constructed elevated work platform.
2. Utilize other engineering feasibility for working from elevated working
position.
3. Utilize other engineering feasibility for the "problem(s)" associated
with the topsoil screener
operation.
4. Train and instruct employees in regard to working from the elevated
bucket of an excavator.
