Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were expose to multiple injuries from falls:
WORK SITE: Employees having  access to the roof by stepping onto the mid
and top rails of
a Skyjack 600 model SJ735 scissor lift and stepping across the parapet
were exposed to a 16 foot
fall hazard.
Among other methods, one feasible and acceptable methods to correct the
hazard is to:
1. Ensure the use of an existing fixed ladder on the building,
2. Utilize properly designed scissor lifts with modified rails which will
allow access/egress to
elevated walking/working surfaces safely,
3. Utilize other engineering feasibility, such as, but not limited to
safety harnesses with double
lanyards.
