Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to serious multiple broken bones and/or death: WORKSHOP: The Toyota powered industrial truck, used to lift personnel to retrieve stocks from the overhead storage shelves was not equipped with a firmly secured "safety platform" and a means whereby the personnel on the platform could shut off the power to the truck nor was an equivalent means of protection provided and utilized. Among other methods, one feasible and acceptable method to correct the hazard is to: 1. Follow the requirements of the American National Standard Institute standard, ANSI B56.1, for Powered Industrial Trucks. 2. Follow the forklift truck manufacturer's operating procedures and recommendations. 3. Utilize other safe engineering feasibility.
