Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to "crushing" hazard created by "stored material"  or in the
alternative; 29 CFR
1910.176(b): Material stored in tiers was not stacked, blocked,
interlocked or limited in height
so that it was stable and secure against sliding and collapse:
64 SOUTH TURNPIKE ROAD, WALLINGFORD, CT: The employer did not ensure
through
a visual observation, inspection and utilizing appropriate equipment that
the materials stacked
up position in tiers inside the trailer were stable and secure against
"displacement" not only
during storage/transportation, but also removal process.
On or about 5/30/06, a "bundle" of materials that was stacked up in tiers
and held only by two
(2) straps against the wall of a trailer fell and struck on one of
employees
who were in the
process of removing the above material. The employee sustained multiple
severe injuries from
the incident.
Among other methods, one feasible and acceptable method to correct the
hazard is to:
1. Ensure the use of temporary supports or bracing devices.
2. Develop and implement safe work practices that address methods to
stabilize unstable
material.
3. Train employees in the use of temporary supports/bracing and safe work
practices.
4. Utilize other "stacking" method(s), such as (but not limited to)
stacking them on the floor.
5. Utilize other available engineering technologies.
