Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that employees were exposed
to the hazard of being struck by
vehicular traffic while performing work functions such as but not limited
to surveying and measuring:
On or About September 4, 2003, a safe work zone consisting of devices such
as but not limited to warning
signs and barriers was not established in the 24 foot 4 inch wide, 136
foot 4 inch long roadway on the west
side of 38 Volunteer Lane in Greenwich, CT where activity such as but not
limited to surveying and
measurement work was being performed.
A Senior Land Surveyor sustained a fatal head injury while performing
surveying and measurement work.
Among other methods, feasible and acceptable abatement method to correct
this hazard would be to establish
work zones with appropriate warning signs and barriers in accordance with
American National Standards
Institute(ANSI) D6.1-1971 or more recent edition, Manual on Uniform
Traffic Control Devices for Streets and
Highways.
